When can I sublet?

During your contract period you can submit an application for permission to sublet to the Housing Department of the Stw Mainz. If the subletting is approved, you may sublet for the approved period. 

In the Corona Pandemic, you can submit applications for subletting for the lecture and lecture-free periods.  

The formal application for subletting is mandatory. Please send the completed application by e-mail to infopoint@studierendenwerk-mainz.de

Example: Today you finally know that you no longer need your room. However, you can only terminate your lease by the 31.03. or your lease ends on 31.03 with the Stw Mainz. You may therefore submit an application for subletting for a period until 31.03.

The formal holiday rental application for subletting with the landlord, the Stw Mainz is mandatory.

You look for a holiday tenant yourself. As soon as you have found a holiday tenant, please send the completed application by e-mail to infopoint@studierendenwerk-mainz.de. Now you wait for the approval by the Stw Mainz.

After the approval by the Stw Mainz you can take the next steps and sign a contract with your holiday tenant.

The potential holiday tenant does not have to be a registered student, but should not be older than 35 years.

Ask yourself if your potential holiday tenant fits into your dormitory or into your shared flat before you accept him/her and propose him/her to the Stw Mainz, because as the main tenant you remain the contractual partner of the Studierendenwerk Mainz for the duration of the subletting

When your holiday tenant returns the room/apartment, you are responsible for the condition of your apartment/room with all rights and obligations agreed upon in the rental contract.
 

Special conditions for shared flats

If you want to sublet your room in a shared apartment (in Hechtsheim, Kisselberg, Oberstadt, Binger Schlag or Weisenau) you have two options.

The simplest: Find a holiday tenant of the same sex.

A little more complicated: You need the written consent of your roommates if your holiday tenant is not of the same sex. The consent of your roommates has to be submitted to the Studierendenwerk Mainz in the form of an informal and signed writing with the application for subletting. Please note that we have to refuse your holiday tenant if your roomates do not agree.

Example: You live in a 2-bed shared flat in Hechtsheim. You have found a student as holiday tenant, your roommate and your potential holiday tenant agree to share kitchen and bathroom with a mixed-gender person and to live together. Both declare in writing that they agree to live together in the 2-person shared flat. You submit this declaration together with your holiday rental application.

If either the holiday tenant or your roommate does not agree with the constellation in the shared flat, please look for another holiday tenant. Without consent the Stw Mainz would have to refuse your application.

In principle, it is possible for the holiday tenant to take over the contract after your contract ends. Two things are necessary for this: Your contract ends and the Stw Mainz, Housing Department agrees.

Example: You have a holiday tenant who rents your room until 31.03 from you. He/she is a student at the JGU, HS Mainz or TH Bingen and would like to rent the room directly from the Stw Mainz and stay in the room from April on. Your holiday tenant fills in the online application for admission for the 01.04 and indicates that he/she would like to take over the room in which she/he already lives. 

Please, also inform the Housing Department about the wishes of your holiday tenant.

Check who is a suitable holiday tenant for you. Please also consider the age and if he/she fits into a life in the dormitory.

You, as the main tenant, remain responsible for us, the landlord (the Stw Mainz), for paying the rent.
 
Ongoing rent payments will continue to be debited from your current account, because you, as the main tenant, remain contractual partner with the Stw Mainz for the duration of the subletting. We will send you reminders about outstanding rent payments and in case of longer outstanding rent payments we will take further legal action against you, if necessary. 

In addition to a freely negotiable rent, which however may not exceed the current all-inclusive rent, we recommend that you negotiate an appropriate deposit with the holiday tenant.

Example: The Stw Mainz debits the rent monthly from your account. Your holiday tenant transfers the monthly rent to you. This way you know for sure if your holiday tenant is able to pay.

We recommend that you arrange a deposit with your holiday tenant in your sublease agreement. Pay it back to your holiday tenant when you have received the deposit back from us. 

We will pay your deposit back to you, as the main tenant, as agreed in the rental contract, if there are no damages when you move out.

Example: Your holiday tenant takes over the handing over of the room to the janitor with your power of attorney and moves out. When the room is returned and it is found that it has not been sufficiently cleaned, therefore a cleaning company has to be hired to clean it. The costs will be deducted from your deposit and thus you are able to deduct the amount from the deposit of your holiday tenant.

If you have already found a holiday tenant, please complete the section in the form and forward the completed holiday rental application form, including a copy of the holiday tenant's identity card, passport and/or visa, to our Info-Point.

You will receive a confirmation e-mail from us with the countersigned application for subletting. Please note that only then the move-in of your holiday tenant is permitted and can take place.

Generally, the janitors in the dormitories are not responsible for handing over your room to your holiday tenant. Please organize this room handover on your own. If you are no longer on site, you could also do this, for example, through friends at the place of study or in the dormitory. 

Before handing over the rental object, we recommend that you take photos of the condition of your room/apartment so that you can assert recourse claims against your holiday tenant in case of doubt.

If the special case should arise that you have already left your keys with the janitor because you were sure that you no longer want to use the room despite the current contract and also do not want to sublet it, but then change your mind, costs may arise for renewed room inspections, cleaning, janitor services and repairs.

Make a written holiday rental agreement with the holiday tenant. Very good templates for this can be found free of charge at major online real estate providers.  
In your own interest, we advise you to have the passport or identity card of the holiday tenant shown to you in order to check his or her identity or have a copy sent to you.

As soon as your holiday tenant has moved in, he/she can pick up a guest account for free use of the internet at our Info-Point. When picking up the account, the holiday rental agreement together with passport/ID card must be kept ready and presented.

Sublease

Any (even partial) subletting or transfer of use of the rented rooms to third parties without the express written permission of the Studierendenwerk Mainz is strictly prohibited.

For the processing of the holiday rental application, a one-time administration fee of 50.00 € will be charged as soon as the holiday rental application is received at the Studierendenwerk Mainz.

As the main tenant, you remain the contractual partner of the Studierendenwerk Mainz for the duration of the vacation rental. In this respect, all current rent payments will continue to be debited from your current account. In addition, you are responsible for the condition of your apartment/room with all rights and obligations agreed upon in the rental contract when your holiday tenant returns the rented property.

In advance, you conclude a rental contract with the holiday tenant yourself. In addition to a freely negotiable rent, which may not, however, exceed the current all-inclusive rent, we recommend that you negotiate a fair and reasonable deposit. In your own interest, we advise you to ask for a copy of the passport or identity card of the holiday tenant. You should also take photos of the condition of your room/apartment before handing over the rental object, so that you can make a claim of recourse against your holiday tenant in case of doubt.

Only you or a person authorised by you can hand over the keys to your holiday tenant. Please note that our house technicians will not hand over or inspect the rooms during the holiday rental. The smooth move-in and move-out of your holiday tenant is solely your responsibility.
Your holiday tenant will get a guest account for free to use the internet during the stay of the holiday rental agreement. Detailed information under “Internet for holiday tenant”.
