When can I sublet?
During the lecture-free period (from 01.02. to 31.03. / 01.07. to 30.09.) you can submit an application for approval of a vacation rental to the Housing Department of the Stw Mainz. If you are approved for a vacation rental, you may rent for the approved period.
If your contract is due to expire in the current semester, vacation rentals are no longer possible.
The formal application for vacation rental is mandatory for this purpose. Please hand in the original application at the Infopoint or send it to us by mail.

The formal application to the landlord, the Stw Mainz, is mandatory.
You look for a subtenant yourself. As soon as you have found a subtenant, hand in the completed application form, including copies of your ID and matriculation papers, at the Infopoint or drop it in the mailbox at Staudinger Weg 21. Now wait for feedback from the Stw Mainz.
After approval by the Stw Mainz you can take the next steps and sign a contract with your vacation tenant.

During the lecture-free period (from 01.02. to 31.03. / 01.07. to 30.09.) you can only rent to students. Therefore, in addition to each application, we require a copy of the identity document and a certificate of enrollment of the vacation tenant(s). Please remember that vacation tenants should not be older than 35 years in any case.
In addition, please ask yourself whether your potential tenant fits into your dormitory and, if applicable, into your shared apartment before you accept him or her and propose him or her to the Stw Mainz, because as the main tenant you remain the contractual partner of the Studierendenwerk Mainz for the duration of the vacation rental.
Upon return of the rental property by your vacation tenant, you are responsible for the condition of your apartment/room with all rights and obligations agreed upon in the rental contract.

If you want to rent your room in a shared apartment you have two options:
The simplest: find a* vacation tenant* of the same sex.
A bit more complicated: You need the written consent of your roommates if your vacation tenant is not of the same sex. The consent of the roommates has to be in writing with signature and informally and has to be submitted to the Studierendenwerk Mainz together with the application for a vacation rental without being asked. Please note that if you do not give your consent, we will have to reject your vacation tenant.
Example: You live in a 2-person shared apartment in Hechtsheim. You have found a student as a vacation tenant, your flatmate and her potential vacation tenant agree to share the kitchen and bathroom of mixed sex and to live together. Both declare in writing that they agree to live together in the 2-person shared apartment. You will submit this statement with your vacation rental application.
If either the vacation tenant or the roommate do not agree with the constellation in the shared apartment, it is best to find another vacation tenant. The Stw Mainz will have to refuse without consent.

In principle, it is possible for the holiday tenant to take over the contract after your contract ends. Two things are necessary for this: Your contract ends and the Stw Mainz, Housing Department agrees.
Example: You have a holiday tenant who rents your room until 31.03 from you. He/she is a student at the JGU, HS Mainz or TH Bingen and would like to rent the room directly from the Stw Mainz and stay in the room from April on. Your holiday tenant fills in the online application for admission for the 01.04 and indicates that he/she would like to take over the room in which she/he already lives.
Please, also inform the Housing Department about the wishes of your holiday tenant.

Check who is suitable for you as a vacation tenant. Also take into account the age and the fit with the reality of life in the residence.

You, as the main tenant remain responsible for us, the landlord (the Stw Mainz) for the rent payment. Current rent payments will continue to be debited from your current account, because you, as the main tenant, remain the contractual partner for the Stw Mainz for the duration of the vacation rental. We will send you reminders for outstanding rent payments and, if necessary, we will take further legal action against you if the rent payments remain unpaid for a longer period of time. In addition to a freely negotiable rent, which may not exceed the current flat rent, we recommend that you negotiate an appropriate deposit.
Example: The Studierendenwerk Mainz debits the rent from your account every month. Your* vacation tenant transfers the monthly rent to you. In this way, you know for sure whether your vacation tenant will meet the payment obligation.

Basically, the janitors in the dormitories are not responsible for handing over your room to your vacation rental. Please organize this room handover on your own. If you are no longer on site, you could also implement this, for example, through friends at the study location or in the dormitory.
Before handing over the rental property, we recommend that you take photos of the condition of your room/apartment so that you can assert recourse against your vacation rental in case of doubt.

Conclude a written vacation rental agreement with the vacation tenant. You can find templates for this free of charge at major online real estate providers.
In your own interest, we advise you to ask to see the passport or ID card of the vacation tenant to verify the identity or to have a copy sent to you.

As soon as your vacation tenant has moved in, he/she can pick up a guest account for free use of the Internet at our Info Point. When picking up the account, please have your passport/identity card ready and present it.
subletting during the lecture-free period
students is generally prohibited without the express written permission of the Studierendenwerk Mainz.
However, you have the possibility to sublet your room/apartment during the lecture-free period from 01.02. to 31.03. / 01.07. to 30.09. within the framework of vacation rentals. (§ 9 of our general rental conditions).
A one-time administrative fee of € 75.00 will be charged for processing the vacation rental application as soon as the application for approval of the vacation rental contract has been received by the Stw Mainz.
As the main tenant, you remain a contractual partner of Studierendenwerk Mainz for the duration of the vacation rental. All current rent payments will continue to be debited from your current account. In addition, you are responsible for the condition of your apartment/room with all rights and obligations agreed upon in the rental contract when your vacation tenant returns the rental object.
n advance, you will conclude a rental agreement with the vacation tenant* yourself. In addition to a freely negotiable rent, which may not exceed the current flat rent, we recommend that you negotiate a fair and reasonable deposit. In your own interest we advise you to ask for a copy of the passport or identity card of the vacation tenant. In addition, you should take photos of the condition of your room/apartment before handing over the rental property, so that you can claim recourse against your vacation tenant in case of doubt.
The handing over of the keys to your tenant will only be done by you or a person authorized by you. The smooth move-in and move-out of your tenant is your sole responsibility.
Your vacation tenant will be provided with a free guest account for Internet use for the period of the approved vacation rental. Please refer to: "Internet for vacation tenants".
